Some Benefits and Drawbacks of Denmark Greencard

You are at liberty to health care when you are legally resident in Denmark. To be legally resident in Denmark, you must list with the National Registry (CPR) after your entrance. This procedure can take more than a few weeks. Once this procedure is complete, you will take delivery of notification that you have right to Danish health care. In anticipation of that time, you have to extract private insurance o cover this temporary period until you are officially covered by public health insurance.

Foreign nationals are not eligible for public assistance. If you receive public help where you are not permitted to it, your Green Card habitation permit can be withdrawn. Please keep in mind that qualifying decisive factors for the Green Card scheme includes your aptitude to hold up yourself during your first full year in Denmark. On entrance in Denmark you must comprise proof that you own financial resources equal to one year of Danish Start Help benefits.

Time Limit of arrival after getting Denmark Greencard

Remember that a residence permit of Denmark issued under the Greencard Scheme end in 6 months after the date of issue. Thus the winning candidates have to arrive in Denmark, with the purpose of working and residing, within 6 months of the issuance of the Danish residence permit. This time period is fixed. The dates of your residence permit cannot be distorted. If you are not capable of travelling to Denmark sooner than the end of the 6 month period then your visa will turn out to be invalid and you will require making a application for an extension. The Green Card residence permit gives you authorization to work and live in in Denmark. It also gives you and right to travel to a different Schengen country as maintained by a standard Schengen visa. This means that you can take a trip on a Green Card residence permit for up to 90 days in any other Schengen country. You may furthermore travel to other Schengen countries on your way to ‘activating’ your GreenCard residence visa in Denmark.

Modification in time period for Greencard permissions

Fresh applications under the Danish Greencard scheme which are handed in after the 25 March, 2010  will only be approved a primary residence permit of Denmark for 18 months. Previous to the end of this first period, you can submit an application for an expansion of up to 2.5 years. Previous to the end of this second period of 2.5 years, you can submit an application for an extension of up to four years.

Your residence permit of Denmark can be extended if you have employed for the past 12 months for a smallest amount of ten hours per week. If you put forward your application after your permission have expired you will be measured an illegal resident in Denmark.

Your residence permit can be extended for one year if you have misplaced your job through no liability of your own (e.g. due to downsizing) no more than three months previous to applying for an extension, and if before this, you worked for 12 months for a smallest amount of ten hours per week.

Old applications handed over before and on the 25 of March will still have 3 year permission.

New Processing Times of The Danish Green Card Scheme

As a result of the unpredictably high demand the publicized processing times have in some cases had to be extended by the supervision authority in Denmark, the Danish Immigration Service (DIS).
In universal terms DIS approximate that applications made in 2009 will be review as follows:

- In case, your application was prepared in the initial half of 2009 (i.e. January to June), then it will be evaluated in the fourth quarter of 2010, with a result expected in the fourth quarter of 2010 or near the beginning 2011.
- In case, request was made in the second half of 2009 (i.e. July to December), then it will be evaluated in first fourth quarter of 2010, with a result expected in the opening quarter of 2011.

For Danish Green Card applications made in 2010, DIS’ will in wide-ranging cope with the application within 6-9 months.

Denmark Greencard Appeal Process

In case your Greencard application is being rejected due to whatever case, you can appeal the Immigration Service’s decision to the Ministry for Refugee, Immigration and Integration Affairs. Though, appeals concerning the Immigration Service’s rulings about asylum should be submitted to the Danish Refugee Council. In addition, appeals cannot be submitted concerning the Immigration Service’s decision pursuant to § 42a, section 7, point 1, regarding somewhere to live.

Who can appeal to the ministry?
An overseas national who is covered by the Immigration Service’s ruling can appeal to the Ministry.

In support of the foreign national who is covered by the Immigration Service’s decision, party representatives can appeal concerning the Immigration Service’s decision to the Ministry. The Ministry considers certain professional parties as party representatives, who can plea to the Ministry regarding the Immigration Service’s decision without written power of attorney.

The Ministry also judges the next relatives living in Denmark as party representatives who, in support of the foreign national, can request to the Ministry without written power of attorney. For instance, parents, siblings, children of legal age and a spouse occupant in Denmark can appeal to the Ministry about the Immigration Service’s rulings in habitation permit cases, e.g. cases concerning family reunification.

How is an appeal submitted to the Ministry?

The appeal can also be submitted to the Immigration Service, which then onward the appeal to the Ministry. In cases concerning visas, the appeal is however submitted to the ministry. You can send an appeal by telefax: 33 11 12 39, or by email: inm@inm.dk.

You can submit your appeal by referring personally to the ministry on weekdays from 9 a.m. to 12 noon.

Things to be included in Appeal:
The appeal must have information about the immigration number of the case or the IVR number and a copy of the Immigration Service’s ruling.

To cut down the case processing time to the extent that likely concerning visa cases in the ministry, documents that are presented relating to an appeal about rejection of visa must be translated to Danish, English, French or German.
